Please read these terms carefully before using the wheel. They explain what you can expect from us, what we expect from you, and the limits of our responsibility when a spin decides something that matters.

1. Agreement to these terms

These Terms and Conditions (the "Terms") govern your access to and use of the website spinthenamesofwheel.com and the Wheel Spinner tool, blog, and related pages published on it (together, the "Service"). The Service is operated by Wheel Spinner ("we", "us", "our").

By opening the site, spinning the wheel, submitting the contact form or otherwise using the Service, you confirm that you have read these Terms and agree to be bound by them. If you do not agree with any part of them, please stop using the Service.

2. Who may use the Service

The Service is offered to the general public and is free of charge. If you are under the age of majority in your country, you may use the Service only with the involvement of a parent, guardian or teacher who accepts these Terms on your behalf.

Where a teacher, school, employer or organisation uses the Service with students or staff, that organisation is responsible for ensuring the use complies with its own policies and with any laws that apply to it, including data protection rules covering the names it enters.

3. Licence to use the Service

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for lawful purposes, including commercial ones such as running a giveaway for your business. This licence does not transfer any ownership in the Service to you.

4. Acceptable use

You agree not to:

use the Service for any unlawful purpose, or for any gambling activity that requires a licence you do not hold;
enter names or text that are defamatory, harassing, obscene, hateful, or that infringe anyone's rights;
attempt to interfere with, overload, probe or disrupt the site or the servers that host it;
use automated systems to scrape, mirror or bulk-download the site beyond normal search-engine indexing;
reverse engineer the Service in order to present it as your own product, or remove attribution from copies of its code;
misrepresent the results of a spin, or present a manipulated recording of the wheel as a genuine draw.

We may restrict or block access where we reasonably believe these rules have been broken.

5. Your content

The names, words and lists you place on the wheel are your content. They are processed in your browser and are not transmitted to us, so we neither store nor moderate them. You remain solely responsible for having the right to use any personal data you enter, including students' or customers' names.

Because your content stays on your device, we cannot recover a list you have deleted or lost. Use the "Download .txt" option to keep your own copy of anything important.

6. Randomness and results

The wheel selects a result using the random number generator provided by your web browser. We have designed it so that every entry occupies an equal segment and no entry is favoured. However, the Service is provided for general use and is not certified, audited or approved as a gaming or lottery random number generator.

If you are running a draw that is regulated in your jurisdiction — for example a prize competition, sweepstake or lottery subject to licensing — it is your responsibility to confirm that using this tool satisfies the applicable rules. We accept no liability for a draw being challenged, voided or penalised.

7. Availability of the Service

We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. The site may be unavailable during maintenance, hosting problems, or events outside our control. We may add, change, suspend or withdraw features at any time without notice.

8. Intellectual property

The Service, including its design, layout, logo, graphics, wheel implementation, source code and written articles, is owned by us or our licensors and is protected by copyright and other intellectual property laws. The name "Wheel Spinner" and the site logo are used as our marks in connection with the Service.

You may quote short extracts from our articles with clear attribution and a link to the original page. You may not copy the site wholesale, republish the articles in full, or present the tool as your own product.

9. Third-party links and services

The Service loads a web font stylesheet from Google Fonts, and the blog may link to third-party websites for reference. We do not control those third parties, are not responsible for their content or practices, and their inclusion is not an endorsement. Review their terms and privacy policies yourself.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be error-free, that defects will be corrected, or that it will meet your specific requirements.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or connected with your use of the Service — including any decision, draw result or dispute that follows from a spin.

Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the amount you have paid us for the Service, which is zero, or the minimum amount permitted by applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your infringement of the rights of any third party, including in the personal data you enter on the wheel.

13. Privacy

Our handling of information is described in the Privacy Policy, which forms part of these Terms. In short: the wheel runs in your browser, your entries are not uploaded, and we do not require an account.

14. Changes to these Terms

We may update these Terms to reflect changes in the Service or in the law. The revised version takes effect when it is published on this page, and the date at the top of the page will change. Continuing to use the Service after that point means you accept the revised Terms, so please check back occasionally.

15. Governing law and disputes

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Where mandatory consumer protection laws of your country of residence give you additional rights, those rights are not affected.

Before starting any formal proceedings, please contact us so we can try to resolve the matter directly. Most issues are settled quickly by email.

16. Severability and entire agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions stay in full force. Our failure to enforce a right is not a waiver of that right. These Terms, together with the Privacy Policy, form the entire agreement between you and us concerning the Service.
